◆楽曲についてのガイドライン

​

■1.楽曲について
二次創作等含め楽曲を利用される方は、以下の利用規約をよくお読み頂いた上でご利用下さい。
利用して頂いた時点で本規約の内容を承諾したものとみなされ、かつこれに従うものとします。 
また、楽曲の著作権は全て湯ノ山かがりに帰属します。下記ガイドラインに沿わない形での無断使用は禁止しております。

湯ノ山かがりのオリジナル楽曲について、常識の範囲内で、配信での歌枠、「歌ってみた」「演奏してみた」等二次創作は以下ガイドライン記載条件のもと許可いたします。各種動画サイト、SNS等で公開も可能です。

※歌ってみた/歌枠等で使用したい方向けに、BOOTHにてオフボーカル版付きの音源を販売しております。利用規約をご確認・遵守の上、ご利用ください。

 

※商用利用等で金銭が発生する場合は、事前のご連絡・許諾必須とさせて頂きます。本ウェブサイトの問い合わせフォームよりご連絡ください。
(収益化済みのYouTubeチャンネル等での投げ銭や広告収入は、商用利用と見なしませんのでご連絡不要ですが、教えて頂いたら喜んで見に行きます！)

※わたし湯ノ山かがりの楽曲は全てJASRAC/NexToneへ著作権管理委託済み+YouTube ContentID登録済みとなっております。
歌ってみた/演奏してみた等の投稿の際は、上記著作権管理団体と包括契約済みのサービスでの投稿を推奨いたします。
(例)YouTube/ニコニコ動画/ツイキャス/IRIAM...etc.

1. Purpose of releasing the song and scope of use
In addition to enjoying it for yourself, you can use it as singing segments during live streams, "Me Singing" and "Guitar Cover" etc.

*If you'd like to use for commercial use, etc., prior contact and permission is required. Please contact me using the contact form.
(Tipping and advertising revenue from monetized YouTube channels etc. are not considered commercial use, so there is no need to contact me.)

*The copyrights of all of my songs have been managed by JASRAC/NexTone and are registered with YouTube ContentID.
When posting videos of me singing or playing, we recommend posting through a service that has a comprehensive contract with the copyright management organizations listed above.
(e.g.) YouTube/Nico Nico Douga/twitcasting.tv/IRIAM...etc.

Please note that if you post using a service other than those listed above, you may be required to complete separate license procedures and pay usage fees.

■2.楽曲データの加工・改変に関して
必要に応じてループ処理、カット、テンポ変更、リアレンジなどをして頂いても構いません。
ただし、改変/無改変問わず、楽曲データの再配布や再販売は禁止とさせて頂きます。

[※ご自身の楽曲等でのサンプリング使用について]
サンプリングでの使用は音楽家としての良識とセンスをもってお願いいたします。
あまりにセンスの無い/レベルの低い/その他わたし(湯ノ山かがり)が不適切と判断するサンプリング使用はしかるべき対処をとらせて頂く場合がございます。

2. Regarding processing and modification of song data
You may loop, cut, change the tempo, rearrange, etc. as needed.
However, redistribution or resale of song data, whether modified or not, is prohibited.

[※Regarding the use sampling in your own songs, etc.]
When using samples of the music, please use your good sense and pride as a musician.
We may take appropriate action against the tracks using samples of my musics are too tasteless/low level/or otherwise deemed inappropriate by me.

■3.クレジット表記に関して
個人で楽しんでいただく以外の各種利用に際し、クレジット表記は必須とさせて頂きます。
※各種イベントや店頭でのBGMとしての使用等、クレジット表記が物理的に難しい場合のみ、表記は任意とさせて頂きます。
動画/配信画面内もしくは概要欄等に「湯ノ山かがり」のクレジット(作詞/作曲/編曲者として)及び元楽曲MVのURLを表記ください。

3. Regarding credit notation
Credit notation is required for any use other than personal enjoyment.
*Credit notation is optional only when it is physically difficult to do so, such as when used as background music for various real events or in stores.
Please include the credits ("Kagari Yunoyama"=lyricist/composer and URL of original music video) in the video/streaming screen or description.

■4.禁止事項
下記に該当する使用は禁止とさせて頂きます。

・法令に違反する、または公序良俗に著しく反する制作物やコンテンツで使用。
(成年向けゲーム等コンテンツでのBGMとしてのご使用は禁止しておりません。)

・特定の政治・宗教その他イデオロギーに関する制作物・コンテンツでの使用。

・著作権管理団体やYouTube ContentID等著作権管理システムへの重複登録。

・改変/無改変に関わらず楽曲を二次配布すること。

・第三者が容易に音源ファイルにアクセス・複製できる状態での利用。

・楽曲そのものを公開・提供する目的での無断使用(YouTube等での所謂音源まとめ動画等での公開も禁止です)。

​・各種生成AIサービス等への学習を目的とした無断使用。

・自作と詐称しての使用、または湯ノ山かがり公式と詐称/公式と誤解・誤認されうる形での使用。

・その他、わたし(湯ノ山かがり)が不適切と判断した使用。

4. Prohibited Uses
The following uses are prohibited.

- Use in works or content that violate laws and regulations or are significantly contrary to public order and morals.
(Use as background music in adult games and other content is not prohibited.)

- Use in works or content related to specific politics, religion, or other ideologies.

- Duplicate registration in copyright management organizations or copyright management systems such as YouTube ContentID.

- Secondary distribution of music, whether modified or unmodified.

- Use in a state where third parties can easily access and copy the audio files.

- Use for the purpose of publishing or providing the music itself.

- Using it in a way that is falsely represented as your own work, or falsely represented as an official Kagari Yunoyama work, or in a way that could be mistaken or misidentified as an official work.

- Any other use that I (Kagari Yunoyama) deem inappropriate.

・楽曲もしくは楽曲データを使用した事により生じたあらゆる損害・トラブルについては一切の責任を負いません。
・個別にお問合せ等ご連絡頂いた場合でも、内容によりお返事ができない場合がございます。予めご了承ください。

- I am not responsible for any damage or trouble caused by the use of my songs or data of songs.
- Even if you contact me individually with inquiries, I may not be able to reply depending on the content. Please note.
